SkinnyDip Terms of Use

Welcome to SkinnyDip ("we," "our," "us"). These Terms of Use ("Terms") govern your use of the SkinnyDip mobile application, website, and related services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Eligibility

  • You must be at least 18 years old to use the Service.
  • You represent and warrant that:
    • You are legally permitted to use the Service.
    • You have not been convicted of a felony, sex crime, or violent offense.
    • You are not required to register as a sex offender with any government entity.

2. Account Creation

  • To use the Service, you must create an account by providing accurate, complete, and current information.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
  • We reserve the right to suspend or terminate your account if we suspect false information, impersonation, or misuse.

3. User Content

  • You may upload photos, profile information, and other content ("User Content"). By doing so, you grant us a non-exclusive, worldwide, royalty-free, transferable license to use, display, reproduce, and distribute your User Content solely in connection with operating the Service.
  • You are solely responsible for your User Content. You agree not to upload or share content that is:
    • Offensive, discriminatory, or harassing.
    • Sexually explicit, pornographic, or obscene.
    • False, misleading, or impersonating another person.
    • Violating any copyright, trademark, or other intellectual property rights.
  • We may remove any User Content that violates these Terms or our community guidelines.

4. Prohibited Conduct

You agree not to:

  • Use the Service for commercial purposes, solicitation, or spamming.
  • Harass, threaten, or harm other users.
  • Collect personal data from other users without consent.
  • Use bots, scrapers, or unauthorized tools to access the Service.
  • Post or distribute harmful software, viruses, or malicious code.

5. Matching & Interactions

  • The Service facilitates connections between users for dating or friendship. We do not guarantee compatibility, matches, or relationships.
  • You are solely responsible for your interactions with other users. Exercise caution and follow safety guidelines when meeting in person.
  • We are not responsible for the conduct of any user, whether online or offline.

6. Subscription & Payments (if applicable)

  • Certain features may require a fee. The fees, and clear options for payment, will be disclosed before purchase.
  • All payments are final and non-refundable except as required by law.

7. Privacy

  • Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.
  • By using the Service, you consent to the processing of your data as described in the Privacy Policy.

8. Termination

We reserve the right to suspend or terminate your account, with or without notice, if:

  • You violate these Terms.
  • You engage in harmful or illegal behavior.
  • We choose to discontinue the Service.

9. Disclaimers

  • The Service is provided "as is" and "as available." We make no guarantees regarding uninterrupted availability, accuracy of profiles, or success of matches.
  • We disclaim all liability for damages resulting from user interactions, including but not limited to physical harm, emotional distress, or fraud.

10. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, special, or consequential damages.
  • Our maximum liability to you will not exceed the amount you paid for the Service in the past 12 months (if applicable).

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your interactions with other users.

12. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of Illinois and/or Tennessee.
  • Any disputes will be resolved through binding arbitration or the courts of Illinois and/or Tennessee, unless prohibited by applicable law.

13. Changes to Terms

We may update these Terms from time to time. The updated Terms will be effective upon posting. Your continued use of the Service constitutes acceptance of the changes.
